GOOD NEWS FROM ARIZONA. 🏳️‍⚧️🩷

Trans people born in Arizona now have a clear path to obtaining a birth certificate that accurately reflects who they are without being required to undergo surgery or any other specific medical treatment.

On October 6, the U.S. Court of Appeals for the Ninth Circuit ruled in Roe v. Johnston that Arizona law allows trans people to petition a court for an order changing the s*x marker on their birth certificate. And importantly, a court cannot require proof of surgery or another particular medical treatment before issuing that order.

This is especially important for trans youth.

The case was brought on behalf of a class of transgender Arizonans by the National Center for LGBTQ Rights and its legal partners. The three named plaintiffs are trans children. Two had previously been denied court orders after Arizona courts concluded that surgery was required.

The Ninth Circuit has now made clear: it is not.

And once a court issues an order changing the s*x marker, the Arizona Department of Health Services is required to comply.

Why does something as simple as a birth certificate matter so much?

Because birth certificates are used throughout our lives - for school enrollment, employment, camps and sports, driver’s licenses, passports and countless other situations. When someone’s documents don’t match who they are, they may be forced to disclose that they are transgender every time they present them, potentially exposing them to discrimination or harassment.

One important legal note: the Ninth Circuit did not uphold an earlier ruling declaring Arizona’s surgical requirement unconstitutional. Instead, it concluded that Arizona law already provides a court order that does not require surgery.

Different legal reasoning. But a very meaningful practical result:

Transgender Arizonans do not have to undergo surgery in order to have an accurate birth certificate.

At a time when trans people and their families are facing so many legal and political battles, we’re glad to share some good news. 🩷

Accurate identity documents shouldn’t depend on whether someone has undergone a particular medical procedure.

Trans people deserve documents that reflect who they are.

And trans young people deserve to grow up knowing their identity is worthy of recognition and respect.
