ABISO PARA SA GAGANAPING

Amin pong ipinababatid na magkakaroon ng isang Pampublikong Pagdinig sa inyong barangay na gaganapin sa Ika-13 ng Mayo, Ganap na Ika-09 ng Umaga sa Covered Court ng Brgy. Ilayang Ilasan. Ang paksa ng pampublikong pagdinig ay ang aplikasyon ng Calavite Passage Wind Power Corporation para sa proyektong pagtatayo ng Metrological Mast sa inyong barangay. Ito ay bilang bahagi ng proseso para sa kanilang pag-apela sa naunang desisyon ng Zoning Administrator ng Lungsod ng Tayabas na i-deny ang nasabing proyekto. Hinihiling ng aplikante na mabigyan sila ng deviation sa kanilang aplikasyon sa uri ng isang Temporary Use Permit. Ayon sa Section 35, #3 ng Zoning Ordinance 26-01, sa ilalim ng pangkat ng Deviations - Temporary Use Permit:
The Zoning Section, upon the prior recommendation of the Local Zoning Board of Appeals (LZBA), may allow in a particular area a use other that those expressly allowed by the Zone Use Regulations applicable to such area, provided the following terms and conditions are complied with:
a. The use is temporary in nature, that is, the structures, equipment, machinery, operations and personnel are capable of or amenable to being terminated, transferred or relocated elsewhere within the community after the expiration of the permit or when conditions have become such that their transfer, relocation or termination is necessary in order to promote the public health, safety and general welfare;
b. The area in which the proposed temporary use is sought to be located is not yet built-up that is the designated use has not yet been consumed or used a major portion of the zone, and there is still sufficient available land that will accommodate the needs or demands of the designated uses for the zone; and
c. There is neither predictable pattern of growth or increase in the designated uses of the area, nor of any other particular development.
d. All application for temporary use permit shall be acted upon on a case-to-case basis.
If at any time during the period that a temporary use had been in existence it appears that the trend of development definitely establishes a pattern of growth in favor of such classification and it is desirable to retain and even encourage such classification or Inaatasan ang LZBA Secretariat na magpaskil ng abiso tungkol sa oras at araw ng Pampublikong Pagdinig sampung (10) araw bago ang nasabing pagdinig. Gaganapin ang Pampublikong Pandinig na ito upang malaman ng lokal na pamahalaan ang saloobin ng publiko, lalo ng mga residente at stakeholders ng Brgy. Hayang Ilasan kaugnay ng aplikasyong ito. Mahalaga ang inyong mga saloobin, impormasyon, patunay, at pahayag upang maging bahagi ng proseso at magbigay kalinawan sa Local Zoning Board of Appeals para sa kanilang pagdedesisyon ukol sa nasabing aplikasyon.
