Supreme Court: Religious Ministers May Be Considered Employees and Are Covered by SSS

The High Court held that while the Constitution guarantees religious freedom and upholds the separation of Church and State, these protections apply only to ecclesiastical matters, such as doctrine, worship, ordination, and internal church governance. Determining whether an employer-employee relationship exists for purposes of labor and social security laws is a secular question that courts may resolve.

"An employer-employee relationship may exist between a religious organization and its ministers. It is the existence of this relationship that determines the status and triggers mandatory coverage under the SSS law.

The provisions of the Labor Code and its Implementing Rules and Regulations encompass religious institutions. The nature of these associations does not bar the formation of an employer-employee relationship."
