That's actually what the Bangko Sentral ng Pilipinas is there for.
Sending money to the wrong GCash number doesn't automatically hand ownership to whoever received it. Under Article 2154 of the Civil Code, anything received by mistake — without any legal basis — has to be returned. That's solutio indebiti. The law is pretty clear on this.
Refusing to return it, especially after you've been told about the error, has consequences. At minimum, it's unjust enrichment under Article 22. Push it far enough, and it can become estafa under Article 315 of the Revised Penal Code if there's clear intent to keep what isn't yours.
"Wala kaming magagawa" isn't acceptable from GCash. As a BSP-regulated electronic money issuer under Circular No. 649, Series of 2009, they're required to handle disputes — not brush them off. In this case, escalating to BSP actually worked. The money was returned, with minimal deductions.
The lesson: if a BSP-supervised company stonewalls you, go higher. The regulatory route has teeth.
Kung nagkamali ka ng padala, hindi iyon awtomatikong magiging pag-aari ng nakatanggap. May obligasyon sila sa ilalim ng batas na ibalik ang pera.
