Counter affidavit of the charges, has been completed for tomorrow's hearing.
The legal team of Kapa Community Ministry International Inc. has been completed. the counter affidavit of officials who were first charged with the Department of Justice (DOJ). This was followed by an extension that the legal team requested in the panel of prosecutor to respond to their counter-affidavit on July 29, 2019.
The Kapa legal team has already requested that the Sarangani prosecutor's office solicit their affidavits for filing a court affidavit. The legal team hopes that the DOJ will immediately resolve the case that is expected to favor the Kapa because of lack of evidence and witnesses allegedly accused by religious organizations.
By snubbing the July 15, 2019 DOJ's preliminary hearings from SEC personnel it has slight edge to the Kapa camps due to 'uninterested case' for not showing any sign of interest of the case filed by SEC before the DOJ. Until now, they have no legit complainant from public as they only present their own employees as an undercover agent to disguise as a KAPA member. If the SEC witnesses is not interested to testify or not interested to file a case as they only want to get back their money it may lead to amicable settlement in the next hearing.
On the other hand, according to the 2006 Rules of Procedure of SEC. 5-1, the party or their counsels with the requisite special power of attorney in absence of his client shall be directed to appear before the Hearing Panel on the date set in the notice to consider the following actions:
a.) The possibility of an amicable settlement which includes referral to mediation and other forms of Alternative Dispute Resolution.
b.) The simplification of the issues; and
c.) Such other matters that may aid in the just and speedy disposition of the case.
The Hearing Panel shall terminate the conference if after two conferences, the parties fail to settle their differences.
On SEC 5-2. Amicable settlement, During the conference the Hearing Panel shall ensure that the reasonable settlement of the case. The parties, with or without the assistance of counsel, shall submit during the conference specific proposals or counter-proposals to arrive at an amicable settlement of the case.
Back on July 9, 2019, the SEC approved the Rules and regulation of Crowdfunding where the Donation-Based and Reward-Based are now legal in the Philippines. It means the cyptocurrency like crowdfunding activities in the country are now legal.
