PROPOSAL TO THE EXECUTIVE COMMITTEE OF THE NIGERIAN BAPTIST CONVENTION ON HOSTING 2020 CONVENTION IN SESSION ONLINE
PREAMBLE:
This year’s Convention in Session scheduled to hold from April 18th to 23rd at the Baptist International Conference Centre could not hold because of the lockdown of the Country due to COVID-19 Pandemic which necessitated the postponement of the Annual Session. The leadership have been observing and monitoring the situation in the country since March 27th when the lockdown began to see the possibility of fixing another date for the meeting. However, from all indications, it appears that holding meeting of large gatherings like ours may not be possible this year as the cases of those who have the COVID-19 is on the increase on a daily basis and the possibility of another lockdown not being ruled out.
The President of the Convention having received advice from many quarters mandated a committee of the Admin Council to look at the modalities of hosting the Convention in Session for this year Online and present it to the Admin Council. The report was presented and adopted and hence being presented to the Executive Committee.
OBJECTIVES OF THE ONLINE CONVENTION IN SESSION
The followings are the objectives of the online Convention in Session:
To hold the Convention in Session Annually as stipulated in the Constitution.
To keep the Convention family abreast of the ministries of the Convention.
Leadership should not to be too far from the Convention family.
Demonstration of pro-activeness of the leadership of the Convention as touching alternative means of carrying out Convention ministry and business under whatever condition.
CONSTITUTIONAL PROVISIONS
The committee sort legal opinion from the Convention Legal Adviser. His write up is attached with this report. The summaries of the write up are:
No specific provision is made for a virtual meeting of the Annual Session.
The reality of the exigency of the moment as regards the protocols specified or prescribed by the Government of the Federation of Nigeria encourages virtual holding of meetings for health and safety reasons during the covid-19 pandemic.
There is no single provision contained in the Constitution and Regulations of the Nigerian Baptist Convention that forbids the holding or staging of the Annual Session through virtual or electronic meetings, and it is trite that “everything which is not expressly forbidden or prohibited by law is impliedly permissible”. This is a common law principle, which is binding in the legal system of Nigeria as part of the common law countries.
From Constitutional provisions, the Executive Committee can go ahead to prescribe and execute the manner through which the Annual Session of year 2020 can hold in the light of the requirements of the occasion we find ourselves.
CONDITIONS FOR ONLINE OPTION
The Committee considered the followings:
The medium of hosting the Online Convention must be easily accessible to the Baptist family.
The Medium should be cost effective.
A Technical Committee should be set up to work on the modalities of the hosting by exploring different medium of hosting and the cost implications.
A Technical Committee was put in place headed by Mr Feyisayo Ogunwale, the Principal ICT Officer of the Nigerian Baptist Convention. The Technical Committee was briefed on what is expected of them and asked to report back to the Committee on Friday 19th of June, 2020.
The Technical Committee met and submitted their report to on Friday 19th of June. The Committee met with the Technical Committee on Monday 22nd of June 2020 to discuss the report.
After extensive deliberations, the followings were adopted as the mode of hosting the 2020 Convention in Session Online:
The medium of hosting should be one that can capture face and voice.
The suggested medium of hosting Online Convention will be through ZOOM WEBINAR.
ZOOM Webinar can host a maximum of ten thousand (10,000) people.
ZOOM is the most used medium of interactive webinar or online meeting in the country presently.
Thus, it will be easily accessible to the Convention family.
It also has the least data consumption option when compared with other media.
The Convention in session will be a family meeting; hence it will be a closed and not an open meeting.
A closed meeting is one that is accessible to only those who have or will register to participate in the meeting through Zoom.
An open meeting is streaming the meeting to all that can link up through other channels like Facebook, YouTube etc.
The nature and sensitivity of what will be discussed like Finance, Executive Committee report etc informed the choice of a closed meeting.
PROPOSED PROGRAMME PACKAGE
DAY AND TIME OF THE MEETING
Two days are proposed for the meeting
Saturday afternoon between the hours of 2pm to 5.30pm
Sunday morning through evening between the hours of 7am-12pm; 2-5.30pm
This day will be tagged Convention Sunday
Worship will take place in our churches from 7am to 12noon
Convention family will then hook up on Zoom from 2pm to 5.30pm.
There will also be exchange of pulpit by the Pastors at the Association or Conference level depending on the one that is convenient. The Conference Presidents will organize this.
Convention offerings will be collected and send to the Convention account.

3029 people have registered for this year’s Convention in Session
Those who have pre-registered for the Convention will be charged as follows:
#7000 for those who pre-registered on time
#8000 for those who did late registration
#5000 will be carried over to next year for those who have registered
Churches that wish to register now will pay #8000 per delegate
Convention package and materials will be available in prints and soft copy for those who have registered
Churches and Individuals who have registered will be asked to supply their phone numbers
The access to the Zoom meeting will be sent to them through the numbers
PUBLICITY
Every available means will be used to mobilise for the Convention.
Conferences, Associations and Churches platforms or channels will be used
Departmental Channels: CED, Youth & Students, Publications, Pastors, Deacons, MMU etc
Social media: Facebook, Whatsapp, Telegram, etc
Convention Website and other available ones.
EXISTING ARRANGEMENTS FOR 2020 CONVENTION IN SESSION
There are some existing arrangements for 2020 Convention that was to hold in April. Chief among these are:
Venue of Hosting
Work is ongoing at BICC, since it is our International Camp.
We are proposing that next year’s convention should still hold there
It will be a mark of honor for the President to hold at least a Convention at BICC
If this is agreed to, it will provide easy solution to the second issue.
Accommodation
If the proposal of venue hosting is considered, the office of the President will write a letter to the management of the Redeemed Christian Church of God to maintain status quo of the accommodation already booked for 2021 Convention in Session.
OFFICIAL INFORMATION CHANNEL FOR THE CONVENTION
The advent of COVID 19 has revolutionized channels of information.
Thus, the Convention MUST have a channel of passing information to the Convention family.
TELEGRAM Platform is suggested for this purpose
Telegram can accommodate 200,000 people.
It will be a means of bringing the leadership closer to the people.
It will be interactive and serve as a feedback at times.
Departments will be featured on a weekly or bi-weekly basis.
The President will also have a time of reaching out to the Convention family in interactive sessions.
CONCLUSION
If these propositions are accepted with modifications where necessary, the machinery for planning and ex*****on will be put in place to actualise the dream of having an online Convention in Session this year. We thank members of the Executive Committee for attending this ZOOM meeting to deliberate on this report.

LEGAL OPINION ON THE APPROPRIATENESS OF HOLDING THE ANNUAL SESSION OF THE NIGERIAN BAPTIST CONVENTION FOR THE YEAR 2020 ELECTRONICALLY
Going through the provisions of the Constitution and Regulations of the Nigerian Baptist Convention (Amended at Ibadan, Oyo State on the 1st day of May, 2014), the extant statute which governs the activities of the Nigerian Baptist Convention, by virtue of Regulation 1 (A)(B)(C)(D)(E i & ii) and (F), the content of the Annual Session of the Convention is comprehensively spelt out. See pages 11 and 12 of the said Constitution.
Nevertheless, no specific provision is made for a virtual meeting of the Annual Session. The reality of the exigency of the moment as regards the protocols specified or prescribed by the Government of the Federation of Nigeria encourages virtual holding of meetings for health and safety reasons during the covid-19 pandemic. The same protocol forbids the gathering of large number of people together at a place for any purpose, and therefore, the possibility of our holding of the annual session as the usual practice which involves the large gathering of messengers has been expressly proscribed.
From the foregoing, this occasion calls for a close scrutiny of the provisions of the guiding statute of the Convention to see what solution (if any) can be recommended for the holding of the Annual Session as prescribed by our Constitution.
Article 1 under the Regulations contained in the Constitution at subsection A specifically states that “the place of any annual session shall be determined by the Executive Committee at least one year but preferably two years in advance”. There is no gainsaying that the date and place determined by the Executive Committee for the hosting of the 2020 Annual Session was aborted by the imposition of a lockdown made by the Federal Government of Nigeria. Nevertheless, the power to name the place or prescribe the venue of the said Annual Session constitutionally still resides in the Executive Committee of the Convention and in exercising this power, recourse must be made to the Statute of Interpretation in the Laws of the Federation of Nigeria at Section 10(1)(2) which states thus:-
(1) Where an enactment confers a power or imposes a duty, the power may be exercised and the duty shall be performed from time to time as occasion requires. (Underlining mine for emphasis)
(2) An enactment which confers powers to do any act shall be construed as also conferring all such other powers as are reasonably necessary to enable the act to be done or are incidental to the doing of the act.
The foregoing provisions of the Laws of the Federation of Nigeria have embolden us to state categorically that the power or duty imposed by the Constitution and Regulations of the Convention should be performed and exercised even now as the occasion requires during the covid-19 pandemic.
Section 10(2) of the Statute of Interpretation also supports the Executive Committee of the Convention to act as “reasonably necessary” to enable the Annual Session to hold through virtual or any other electronic means that the Executive Committee may deem fit.
A further scrutiny of the Constitution and Regulations of the Nigerian Baptist Convention reveals that the Executive Committee of the Convention is kitted with power as spelt out in Article IV of the Regulations of the Convention at page 41, paragraph 2(e) which states that the Executive Committee is duty bound “to act for the convention, concerning matters which may arise pertaining to persons, organizations, fellowships, boards, committees, organs etc which derives its creation from the provisions of this Constitution and which in our judgment cannot be deferred until next annual session”.
It is my humble view that the Convention is a creation of the Constitution and Regulations of the Nigerian Baptist Convention. See page 1, Article 1(a) of the said Constitution. Also see paragraph 9 at page 2 of the said Constitution. And what is more? There is no single provision contained in the Constitution and Regulations of the Nigerian Baptist Convention that forbids the holding or staging of the Annual Session through virtual or electronic meetings, and it is trite that “everything which is not expressly forbidden or prohibited by law is impliedly permissible”. This is a common law principle, which is binding in the legal system of Nigeria as part of the common law countries.
From the foregoing, I am of the considered view that the Executive Committee can go ahead to prescribe and execute the manner through which the Annual Session of year 2020 can hold in the light of the requirements of the occasion we find ourselves.
