Economic Freedom Fighters (EFF) leader Julius Malema was sentenced to an effective five years of direct imprisonment on April 16, 2026.
The sentencing by Magistrate Twanet Olivier at the KuGompo (East London) Magistrate's Court follows his conviction for firing a rifle in the air at a 2018 rally.
Sentence Details
Main Charge: Five years for discharging a firearm in a public area and unlawful possession of a firearm and ammunition.
Secondary Counts: An additional two-year sentence for other counts, which will run concurrently with the five-year term.
Fines: Total fines of R60,000 (R20,000 for each of the remaining three counts), with an alternative of six months' imprisonment per count if unpaid.
Firearm Status: Declared unfit to possess a firearm.
Immediate Legal Status
Malema is not expected to enter prison immediately as his legal team has already filed for leave to appeal both the conviction and the sentence. He is likely to remain out on bail while the appeal process, which could reach the Constitutional Court, is finalized.
Political Impact
Under Section 47(1)(e) of the South African Constitution, any member of the National Assembly sentenced to more than 12 months in prison without the option of a fine is disqualified from serving. If the sentence is upheld, Malema could lose his seat in Parliament for five years.

Dr. Bak Barnaba Chol breaks the silence on the incident that led to his arrest

His post reads:

𝐈 𝐰𝐢𝐬𝐡 𝐭𝐨 𝐚𝐝𝐝𝐫𝐞𝐬𝐬 𝐭𝐡𝐞 𝐩𝐮𝐛𝐥𝐢𝐜 𝐝𝐢𝐫𝐞𝐜𝐭𝐥𝐲 𝐫𝐞𝐠𝐚𝐫𝐝𝐢𝐧𝐠 𝐭𝐡𝐞 𝐮𝐧𝐟𝐨𝐫𝐭𝐮𝐧𝐚𝐭𝐞 𝐢𝐧𝐜𝐢𝐝𝐞𝐧𝐭 𝐭𝐡𝐚𝐭 𝐨𝐜𝐜𝐮𝐫𝐫𝐞𝐝 𝐲𝐞𝐬𝐭𝐞𝐫𝐝𝐚𝐲 𝐚𝐭 𝐍𝐢𝐦𝐮𝐥𝐞 𝐁𝐨𝐫𝐝𝐞𝐫 𝐓𝐨𝐰𝐧.

First and foremost, I would like to assure my family, friends, colleagues, and the citizens of our country that I am physically and mentally well. I have not been subjected to any harm or torture. I am in stable condition, except for a slight ankle injury resulting from a dislocation sustained during yesterday’s commotion.
I am currently receiving medical treatment at a hospital, the name of which I have chosen not to disclose for security reasons.

There have been circulating reports suggesting that I was attempting to escape the country due to alleged corruption-related charges, and that I was apprehended as part of a broader list of officials targeted for arrest. I categorically state that I have not been served with any warrant of arrest, and to the best of my knowledge, my name is not among any list of individuals wanted by the authorities.

My presence in Nimule was not an attempt to flee. It was a normal and lawful trip. I had sought and obtained permission to travel for medical treatment in Uganda. While en route, I intended to conduct a brief business survey in Nimule before proceeding across the border for treatment.

As is customary at the point of entry into Uganda, a physical inspection was conducted. During this process, officers found that I was carrying a sum of money, which they proceeded to confiscate. I requested clarification for such action, unfortunately, this led to a misunderstanding and a tense exchange. In the confusion that followed, I left the scene, during which I sustained the ankle dislocation.

I want to reiterate that I am currently under medical care and focusing on recovery. Once I am fully stabilized and fit to move

We recognise Members of County Assemblies (MCAs) as indispensable partners in our national development agenda and a vital link between the aspirations of our people and the policies we craft at the national level.

During the annual County Assemblies Forum, I shared our bold and transformative vision for our great Republic, a vision anchored on unity of purpose, fiscally responsibility, and acelerated socio-economic progress.

Rallied MCAs to stand firmly behind the proposed National Infrastructure Fund, a strategic vehicle that will enable us to mobilise sustainable financing for transformative projects, including roads, airports, dams, irrigation, and electricity connectivity.

Assured them of our full support for the Salaries Remuneration Commission recommendations to reclassify their job groups from D4 to E2.

This reclassification recognises the weight of their responsibilities and the pivotal role they play in strengthening devolution.

Additionally, I reaffirmed our commitment to supporting the County Assemblies Pension Scheme Bill and the Ward Development Fund, both currently before the National Assembly.
