Update: We have received a copy (which I will post here soon) of the letter from the office of Usec Muyot. However, we are merely being copy-furnished with the letter of the Usec to the Regional Director of RXI. It was not a direct response to our letter/petition. None of the issues that we brought up there were discussed. It is clear that the burden is being passed by the Central Office to the Regional Director to make decision regarding our petition. We are now in the process of legal consultation whether the said letter can be used as a basis to make a legal action or not. Let us continue to pray for this advocacy of ours.

Update: The Ombudsman has already replied to our request for RA and has already sent their 1st Endorsement Letter to the Deped Secretary last June 05, 2010. I called the Office of the Undersecretary for Legal Affairs this morning. They have finallly (after five long months) sent a response to our letter and we are now waiting for it in the mail.
As I posted before, if the response is favorable, we will implement it right away; if not, we will file a case in court and use the letter to comply with the court's requirement for exhausting all possible legal remedies.

ExCEL Update: Our position paper is still in the office of the Undersecretary for Legal and Legislative Affairs, Deped Nat'l Office as of this date. I've made several weekly follow-ups by phone but their response was that their legal consultants are still studying our letter--for three months now! According to RA 6713, Sec. 5a, "...All public officials and employees shall, within fifteen (15) working days from receipt thereof, respond to letters..." and so I am now filing for a Request Assistance from the Office of the Ombudsman. Please pray for this next move.

Just thinking out loud...what if we include all those who spread rumors that our Christian schools will be closed, or that our students will not be admitted to other schools, as respondents in the legal action that we are preparing to take. I believe the same amount of filing fee will be required for one or more respondents. But then again...just thinking...or maybe I'm not...or I need to think again. Comments, anyone? -- admin

We are currently waiting from the DepEd Usec for Legal and Legislative affairs for a response to our petition/position letter. If the response will be favorable, then its implementation to all our member schools will follow. If not, then we will take a legal action and use that document as a proof that we have exhausted all possible legal remedies. In the meantime, plans are being made regarding our alternative and temporary solution for our K2 pupils next school-year which is the Phiippine Validating Test (PVT). While waiting for a decision from the court, and/or if we cannot obtain a favorable preliminary injunction, all our K2 pupils shall take the PVT to ensure admittance to other schools. The tentative schedule for simultaneous PVT will be on the first week of February, 2014. The proposed partial schedule of PVT follows:
Monday - Davao City
Tuesday - Davao del Sur
Wednesday - Gensan
Thursday - Davao del Norte
Friday - Comval Province and Agusan
