A significant day for Kenya’s creative industry.

The Copyright Tribunal has granted interim stay orders preserving KAMP’s licence pending the hearing and determination of the appeal. This ensures uninterrupted licensing, royalty collection, and distribution, protecting the livelihoods of thousands of performers, producers, and other rights holders.

KAMP remains committed to transparency, accountability, and serving Kenya’s creative community.

THE MEMBERS WERE HEARD

Today’s proceedings before the Copyright Tribunal marked more than a legal milestone.

For Vicmas Luodollar, Eunice Lema and John Kaloki, it was an opportunity to ensure that the experiences of right holders were placed before the Tribunal.

Having earlier filed affidavits and publicly announced their intention to participate as Interested Parties, the three members, before the Tribunal to highlighted the realities facing many right holders.

In their affidavits, they stated that while they had consistently received royalty distributions consistently from KAMP ;2022, 2023, 2024 , 2025 and 2026, they had only received a royalty payment from PAVRISK once in 2025, despite being members of both Collective Management Organisations.

They argued that these experiences demonstrated why members should not be left out of proceedings that directly affect their rights, royalties and livelihoods. They also reaffirmed their intention to proceed with a class action suit as announced earlier in their public notice, inviting members of KAMP and PAVRISK who believe they have been affected by royalty distribution issues to join them in seeking accountability.

The Tribunal subsequently granted interim orders preserving KAMP’s licence pending the hearing and determination of the appeal.

For these members, today’s proceedings were about more than a court case, they were about ensuring that the voices of all right holders form part of shaping the future of collective management in Kenya.
