Impunity . A flagrant disregard of Court Orders
On the morning of 20th July 2022, contractors employed by the management of Arya Girls High School, on 3rd Parklands Avenue, Nairobi, brazenly trespassed on the property of Arya Samaj Nairobi, a religious institution, and chainsaws in hand proceeded to cut down trees planted years ago on the Arya Samaj premises.
Complaints filed at Parklands Police Station under OB no . went unattended by the Kenya Police, despite being shown an injunction issued on March 22nd 2022, restraining the management from “continuing with or commencing any construction work on the Arya Samaj property.
In flagrant disregard of the Court orders, the management of Arya Girls School, illegally occupied by the Ministry of Education, continue to build structures on the premises against which an injunction has been issued.
Apart from causing damage to private property , the actions of the management of Arya Girls School amount to flagrant disregard of court orders, a test of the power of the Courts’ authority, an abuse of government powers , and a high handed challenge to the rule of law in the country.
The management of the Arya Samaj calls on the Courts to exert their will, and the present government to abide by the law and in this instance not consider it’s organs above the law.
We call upon the national press to have their investigative journalists report on this action in the public interest where the properly court determined right to private property is being challenged with impunity.
